1. Acceptance of Terms

By downloading, installing, or using EzCals ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and EzCals ("we," "our," or "us").

If you do not agree to these Terms, you must not download, install, or use EzCals. Your continued use of the App following any updates or modifications to these Terms constitutes your acceptance of the revised Terms.

We recommend that you read these Terms carefully before using the App. You should also review our Privacy Policy, which describes how we collect, use, and protect your personal information.

2. Service Description

EzCals is a nutrition and calorie tracking application that uses artificial intelligence to analyze food descriptions provided via text input, voice recordings, or food photos. The App provides estimated calorie counts, macronutrient breakdowns (protein, carbohydrates, fat), and personalized nutrition targets based on your profile information.

Key features of EzCals include:

  • AI-powered nutritional analysis of meals via text, voice, or photo
  • Daily calorie and macronutrient tracking
  • Weight tracking and progress visualization
  • Apple Health integration for activity data (steps, active energy, workouts)
  • Personalized calorie and macro targets
  • Optional cloud sync for cross-device access

Important: EzCals is not a medical device and is not a substitute for professional nutrition advice. The nutritional information provided by the App is generated by AI and should be treated as estimates only. Always consult with a qualified healthcare professional or registered dietitian for medical dietary guidance.

3. Eligibility

To use EzCals, you must meet the following eligibility requirements:

  • You must be at least 13 years of age to use the App.
  • If you are between 13 and 18 years of age, you must have the consent and supervision of a parent or legal guardian to use EzCals.
  • You must have the legal capacity to enter into a binding agreement in your jurisdiction.

By using EzCals, you represent and warrant that you meet all of the eligibility requirements listed above. You are responsible for all activity that occurs under your account or on your device in connection with the App.

4. Account & Data

When you use EzCals, you may provide personal information such as your name, age, weight, height, and fitness goals. You are responsible for ensuring the accuracy of the information you provide.

Please be aware of the following regarding your data:

  • Data accuracy: We do not independently verify the accuracy of nutritional data generated by AI analysis. The values provided are estimates based on AI interpretation of your food descriptions.
  • Local storage: By default, all your data is stored locally on your device. You are responsible for maintaining backups if needed.
  • Cloud sync: If you choose to enable cloud synchronization, your data will be stored on secure servers provided by our infrastructure partner, Supabase. Cloud sync is optional and can be disabled at any time.
  • Data deletion: You can delete your data at any time through the App's Settings. See our Privacy Policy for full details on data retention and deletion.

5. AI-Powered Analysis

EzCals uses artificial intelligence to analyze food descriptions and provide nutritional estimates. By using these features, you acknowledge and agree to the following:

  • Estimates only: Nutritional analysis generated by AI is approximate and not guaranteed to be accurate. Calorie counts, macronutrient values, and portion sizes are estimates based on the information you provide and the AI's interpretation.
  • Variability: Actual nutritional values can vary significantly based on preparation methods, ingredients, portion sizes, brands, and other factors that may not be captured in your description.
  • Not a sole resource: You should not rely solely on EzCals for dietary decisions, especially if you have medical conditions, food allergies, or specific nutritional requirements that demand precise tracking.
  • Third-party terms: Our AI providers have their own terms of service and privacy policies that govern their processing of data. By using EzCals's AI features, you also agree to comply with the applicable terms of these providers.
  • Service availability: AI features depend on third-party services and may be temporarily unavailable due to service outages, rate limits, or other factors beyond our control.

6. Health Disclaimer

EzCals is for informational purposes only. Please read this health disclaimer carefully:

  • EzCals does not provide medical advice, diagnosis, or treatment recommendations.
  • The nutritional information, calorie targets, and macro suggestions provided by the App are general guidelines and should not be considered medical or professional nutritional advice.
  • You should always consult with a qualified healthcare professional, registered dietitian, or physician before starting, changing, or following any diet, exercise program, or nutrition plan.
  • EzCals is not intended for use in diagnosing, treating, curing, or preventing any medical condition or disease.
  • If you have an eating disorder or a history of disordered eating, please consult with a healthcare professional before using any calorie tracking application.
  • Apple Health integration is read-only and provided for informational purposes. Activity data displayed within the App should not be used as a substitute for professional health monitoring.
  • We are not liable for any health consequences that may result from dietary decisions made based on information provided by EzCals.

Methodology & Sources

  • Metabolic calculations: Personalized calorie targets are calculated using the Mifflin-St Jeor equation, a widely used predictive equation for resting energy expenditure.   • Nutritional reference data: Nutritional estimates reference the USDA FoodData Central database ( https://fdc.nal.usda.gov/), a comprehensive source of food composition data maintained by the U.S. Department of Agriculture.
  • AI-powered analysis: Food analysis and voice transcription are powered by OpenAI and Anthropic. AI-generated nutritional estimates are approximations and should not be treated as precise measurements.

7. Subscriptions & Payments

EzCals offers both free and paid subscription tiers:

  • Free tier: Core calorie tracking features are available at no cost, subject to certain usage limits.
  • Pro subscription: A paid subscription that unlocks additional features, higher usage limits, and premium capabilities.

All paid subscriptions are managed entirely through the Apple App Store. The following terms apply:

  • All billing, payment processing, and refunds are handled by Apple. We do not directly collect or process payment information.
  • Subscription prices may vary by region and are displayed in your local currency in the App Store.
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store.
  • Free trial periods, if offered, will automatically convert to a paid subscription at the end of the trial unless cancelled.
  • Refund requests must be directed to Apple in accordance with their refund policies.

8. Acceptable Use

You agree to use EzCals in compliance with all applicable laws and in accordance with these Terms. You must not:

  • Reverse engineer or attempt to decompile, disassemble, or derive the source code of the App or any part of it.
  • Abuse AI features by making excessive, automated, or scripted requests to our AI services, or by attempting prompt injection, jailbreaking, or other attacks against the AI systems.
  • Circumvent security measures, rate limits, authentication systems, or any other protective mechanisms implemented in the App.
  • Use the App for unlawful purposes, including but not limited to fraud, harassment, or any activity that violates local, state, national, or international law.
  • Access other users' data or attempt to gain unauthorized access to our systems, servers, or databases.
  • Redistribute or resell the App or any content generated by the App without our express written permission.
  • Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure.

Violation of these acceptable use terms may result in suspension or termination of your access to EzCals.

9. Intellectual Property

The EzCals application, including its design, code, graphics, logos, user interface, and all related intellectual property, is owned by us and protected by applicable copyright, trademark, and other intellectual property laws.

Regarding your content:

  • Your data is yours: You retain full ownership of all data you create within EzCals, including food logs, weight entries, progress photos, and any other personal content.
  • Limited license: By using EzCals, you grant us a limited, non-exclusive, revocable license to process your data solely for the purpose of providing the EzCals service (e.g., sending food descriptions to AI for analysis, storing data for cloud sync).
  • No further use: We will not use your content for any purpose other than providing and improving the EzCals service. Your data will never be used to train AI models, create marketing materials, or for any other commercial purpose.

You may not copy, modify, distribute, or create derivative works based on EzCals or any of its components without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • EzCals is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • We are not liable for inaccurate nutritional information provided by AI analysis. All calorie and macronutrient values are estimates.
  • We are not liable for any health decisions made based on data or information provided by EzCals.
  • We are not liable for data loss. While we take reasonable measures to protect your data, we strongly recommend enabling cloud backup for important information.
  • In no event shall our total aggregate liability exceed the amount you paid us in subscription fees during the 12 months preceding the event giving rise to the claim, or $50 USD, whichever is greater.
  • In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or the theory of liability.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

11. Termination

We reserve the right to suspend or terminate your access to EzCals at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may stop using EzCals at any time. To fully remove your data:

  • Delete your data through the App's Settings before uninstalling.
  • Uninstall the App from your device to remove all locally stored data.
  • If you have enabled cloud sync, contact us at legal@ezcals.com to request deletion of all cloud-stored data.
  • Cancel any active subscriptions through your Apple ID account settings.

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination (including, but not limited to, intellectual property provisions, disclaimers, and limitations of liability) shall continue in effect.

12. Changes to Terms

We reserve the right to modify, update, or replace these Terms of Service at any time. When we make changes, we will update the "Last updated" date at the top of this page.

For material changes that significantly affect your rights or obligations, we will provide prominent notice within the EzCals app prior to the changes taking effect. This may include an in-app notification or a banner displayed when you open the App.

Your continued use of EzCals after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue your use of the App.

13. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of EzCals shall first be attempted to be resolved through informal negotiation. If informal resolution is not possible, the dispute shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association in your jurisdiction, where permitted by law.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.
